8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Claybot Trading, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, our Service.
In no event shall Claybot Trading's cumulative liability for any claim arising out of or relating to your use of the Service exceed the amount paid by you to Claybot Trading for the Service in the twelve (12) months preceding the event giving rise to the claim, or £100.00, whichever is greater.
9. Indemnification
You agree to defend, indemnify, and hold harmless Claybot Trading and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) content posted on the Service.
10. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of England, United Kingdom, without regard to its conflict of law provisions.
